01 Agreement to these terms
These Terms of Service ("Terms") govern your use of the Startscalr website at startscalr.com and the free growth audit offer, including the intake form and any related calls or messages. By using the site or submitting your information, you agree to these Terms and to our Privacy Policy.
If you do not agree, please do not use the site.
02 The free growth audit
The free growth audit is a free, live, roughly 30-minute call where we look at your home service business and show you where your marketing pipeline is losing jobs, from missed calls to quotes that never get followed up. It is a diagnostic conversation, not a paid engagement, and it does not create any obligation for you to buy anything.
We offer it as a courtesy and may change, limit, or withdraw it at any time without notice. Booking a call does not guarantee a call will take place if a slot becomes unavailable or if details cannot be confirmed.
03 Who can book
The audit is intended for home service business owners and operators who are at least 18 years old. The live call is aimed at businesses past a certain revenue stage. If your business is earlier than that, we may instead point you toward resources that fit your stage better. You confirm that the information you give us is accurate and that you are authorized to share it.
04 No guarantees and no professional advice
The audit and anything we share on it are for general informational purposes. They are our opinion based on a short conversation, not legal, financial, tax, or professional advice, and they are not a substitute for advice from a qualified professional.
The free audit itself carries no guarantee of any particular result, saving, revenue, or outcome. Any performance guarantee we advertise applies only to paid engagements under a separate signed services agreement, on the terms written in that agreement. What you do with the ideas from the audit is your decision and your responsibility.
05 Communications and consent
When you submit your details, you agree that Startscalr may contact you by email, phone, and text message about your audit and your request. Message and data rates may apply, and you can opt out of texts at any time by replying STOP. How we handle your contact details is described in our Privacy Policy.
06 Other products and services
We may point you to other Startscalr products and services, such as our marketing packages for home service businesses, which are sold separately and carry their own terms, pricing, refund rules, and guarantees set out at the point of purchase or in a signed agreement. Those terms govern any purchase you make. Nothing on this page is an offer to sell a paid service on its own.
07 Intellectual property
The site and its content, including text, design, graphics, logos, and the Startscalr name, are owned by Startscalr or its licensors and are protected by intellectual property laws. You may view and use the site for your own personal and business use. You may not copy, resell, republish, or use our content or brand for your own commercial purposes without our written permission.
08 Acceptable use
You agree not to:
- Submit false, misleading, or someone else's information.
- Use the site to break the law or infringe anyone's rights.
- Interfere with, overload, or try to gain unauthorized access to the site or its systems.
- Scrape, copy, or harvest data from the site by automated means without permission.
09 Third-party services and links
The site relies on third-party services, such as scheduling, messaging, and hosting providers, and may link to other websites. We do not control those services or sites and are not responsible for their content, availability, or practices. Your use of them is governed by their own terms and policies.
10 Disclaimer of warranties
The site and the audit are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error free, or secure.
11 Limitation of liability
To the fullest extent allowed by law, Startscalr and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of the site or the audit. Because the audit is provided free of charge, our total liability to you for any claim relating to it will not exceed one hundred US dollars.
12 Indemnification
You agree to indemnify and hold Startscalr and its operator harmless from any claims, losses, or expenses, including reasonable legal fees, arising from your misuse of the site, your breach of these Terms, or your violation of any law or third-party right.
13 Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict of law rules. You agree that the courts located in Toronto, Ontario have exclusive jurisdiction over any dispute relating to these Terms or the site, unless your local consumer law gives you a right that cannot be waived.
14 Changes to these terms
We may update these Terms from time to time. When we do, we will change the date at the top of this page. Your continued use of the site after an update means you accept the revised Terms.
